prepare for bankruptcyWhen you make an appointment to meet with a bankruptcy attorney you are probably wondering what are the steps in the bankruptcy process and where do I go from here. If you are debating whether you should speak to somebody about your financial issues, then you probably should as waiting until the very last minute, for instance the day before a foreclosure, is not enough time in which to get the best help. So save yourself and your attorney trouble and plan early for what steps may need to be taken. When you come to your initial consultation you should have some idea of your debts, income, and expenses. You should also be aware of any transfers of property made in the last year or creditors you have paid over $600 in the last 90 days. It would also be a good idea to think about what assets you own and how much they are worth, including a home. In Washington state we get to use Federal or state exemptions to protect your assets. Your attorney will need to know about your assets in order to determine which set of exemptions to use. Depending on your situation you may be able to file your case immediately or you may have to wait several months prior to getting your case filed. Your bankruptcy lawyer will advise you whether now would be the proper time to file.

Prior to the actual filing of your case you should provide your attorney with your last 6 months of paystubs, last 2 years of tax returns, bankruptcy questionnaire, current bank statements, complete the required credit counseling course, pay your attorney fees and provide any lawsuit documents or collection letters that you may have recently received. This information will be used to prepare and file your bankruptcy petition.
